O decreto que flexibiliza às escolas regulares e matricularem alunos com deficiência

O presidente da República, em 30 de setembro, lançou o decreto 10.502/2020 que institui a nova política nacional de educação especial (PNEE), medida, que na prática, tira a obrigatoriedade da escola comum em realizar a matrícula de estudantes com deficiência e permite a volta do ensino regular em escolas especializadas. Dependendo do posto de vista, pode ser visto como liberdade ou segregação.

O ministro da educação, Milton Ribeiro, defende que os principais norteadores dessa política são a valorização das singularidades e os direitos dos estudantes e das famílias no processo da escolha que julgam mais adequada.

Para professora Keila Cristina Oliveira, o decreto é inconstitucional e vai contra toda luta e conquista da educação especial. “Na prática acontece assim, os pais decidem matricular a criança com deficiência em uma escola regular, mas quando chega lá, alguém da escola aconselha que é melhor procurar outra escola que irá atender melhor às necessidades da criança. A partir do momento que a escola pode recusar ou que não recebe recursos para atender crianças com deficiência, não é uma escolha”, diz.

A mãe da aluna Gabriele, Fernanda Padilha teme a inclusão radical, com a justificativa que o ensino regular não está bom e defende a livre escolha dos pais. “As crianças têm o direito de conviverem, mas acredito que os pais também têm direito se serem livres para escolherem o que preferem. Só quem convive com a deficiência sabe o que enfrentamos no dia-a-dia”, comenta.

A última norma relacionada à política nacional de educação especial, foi publicada em 2008, tinha como foco a inserção de pessoas com deficiência em turmas regulares. O censo escolar do Instituto Nacional de Estudos e Pesquisas Educacionais Anísio Teixeira (INEP) de 2019 identificou que 87% dos alunos com deficiência estão em escolas convencionais e em turmas comuns, enquanto apenas 13% estão matriculados em instituições ou classes especiais.

Keila acredita que escola especial não é inclusiva, mas que segrega os alunos. “A inclusão da pessoa com deficiência em todos os espaços sociais não é um favor, é um direito que por décadas vem sendo negado”, acrescentou.
